Unprecedented Lawsuit against the Australian Gambling Industry

An unprecedented lawsuit which is being compared to "David and Goliath" has begun, with a former gambler taking on Australia's powerful gambling industry over claims its products are designed to addict users.

The game in question is Dolphin Treasure a slots game that is manufactured by Aristocrat Leisure. The claim is that the game’s five spinning reels have an uneven spread of symbols, given the perception of almost winning. Another allegation, according to the Sydney Morning Herald (SMH) is ”...Dolphin Treasure's advertised return rate of 87.8 per cent gives the impression that a player will retain 87.8 per cent of the money they bet while risk losing 12.2 per cent, when, in reality, that figure is calculated over the lifetime of a machine and includes jackpots that occasional players rarely win.”

The case launched by Shonica Guy, a former gambling addict, represented pro-bono by the firm Maurice Blackburn. Also in the article by SMH, Ms Guy said, ”she lost 14 years of her life on the pokies, and wanted to stop this happening to other problem-gamblers.”

This case is incredibly historic given that the outcome can create a precedent or reform Australia’s Gambling Laws.
